Definitions

These terms and conditions ("Creator Terms") govern the relationship between Carta Volta ("Carta Volta," "we," "us," or "our"), a brand operated by Hey You! BV (BE-0797.911.805, incorporated in Belgium), and any individual who creates, edits, publishes, or sells one or more digital, interactive travel maps ("Maps") on Carta Volta for professional or commercial use ("Creators," "you," "your").

Carta Volta’s website and web-based application, including all related subdomains, services, features, and payment systems (“Platform”), allow Creators to compile locations and other points of interest, including accompanying information, recommendations, descriptions, and related content (“Pins”) on such Maps, and offer them to anyone who accesses the Platform to view, purchase, or use a Map (“Users”). Access to the Platform is provided through a personal account secured by personal login credentials under the Creator’s control (“Creator Account”).

For each completed transaction in which a User pays the price actually charged (“Sale Price”) for access to a Map through the Platform (“Purchase”), Carta Volta deducts (a) a fixed payment processing fee of €0,49 per Purchase (“Payment Fee”) and (b) a variable percentage of the Sale Price (“Platform Fee”). The amount remaining from completed Purchases after deduction of the Payment Fee, the Platform Fee, applicable VAT, refunds, and chargebacks (”Earnings”) belongs to the Creator.

Creator Eligibility

To use Carta Volta as a Creator, you must be at least 16 years old and have the legal capacity to enter into these terms. If local law requires parental or guardian consent, you confirm that such consent has been obtained. Carta Volta reserves the right to request reasonable proof of consent. By registering for a Creator Account or otherwise using the Platform as a Creator after being presented with these Creator Terms, you confirm that you have read, understood, and accepted them. If you do not agree, you must refrain from any of the above actions.

Creator Responsibility

You are fully responsible for the Maps you create and publish, and confirm that (a) you created the content yourself or have the legal right to use it, (b) it does not infringe third-party rights, and (c) it complies with applicable laws. Maps must not contain or promote illegal, unsafe, misleading, hateful, or harmful content.

Creators are expected to make reasonable efforts to keep their Maps accurate, but do not guarantee that all information will remain current at all times. Information, such as opening hours, pricing, availability, or local conditions, may change due to reliance on third-party data or circumstances beyond the control of both the Creator and Carta Volta.

Carta Volta does not verify the accuracy, availability, legality, or suitability of any Pin. Maps may include personal recommendations, opinions, and local insights from Creators, but do not constitute travel planning services or safety guidance, and Creators are not responsible for User decisions, actions, or outcomes arising from or related to the use of a Map, including with respect to safety, timing, or compliance with local rules or conditions.

Intellectual Property

You retain full ownership of the intellectual property rights in your Maps, and nothing in these terms transfers ownership to Carta Volta. References to the sale of a Map refer solely to the granting of access and usage rights under a license, and do not constitute a transfer of ownership of the Map or its content. Creators remain free to use, license, or sell their Maps or similar content on other platforms or channels, including at different prices.

By publishing a Map, you grant Carta Volta a non-exclusive, worldwide, royalty-free license to facilitate sales to Users through the Platform, including through previews or excerpts, as reasonably necessary to operate and promote the Platform. This license remains in effect for as long as the Map is available on the Platform and for a reasonable period thereafter for legal, accounting, or technical purposes.

Pricing & Fees

For VAT and invoicing purposes, Carta Volta acts as the merchant of record towards Users. Carta Volta collects the Sale Price from the User and subsequently remits and deducts the applicable VAT, Payment Fee, and Platform Fee. These fees cover the intermediary and platform services provided by Carta Volta and do not represent any remuneration for the Map itself.

The Sale Price for a Map is subject to a minimum of €0.10 per Pin included in the Map, though you may set a higher price at your discretion. Carta Volta enforces this minimum Sale Price through the Platform and may take appropriate measures where pricing does not comply due to technical issues, errors, or exceptional circumstances. This may include refusing publication, suspending availability, or requiring price adjustments for Maps that do not meet the minimum pricing requirements.

The applicable Platform Fee depends on the pricing and promotion model selected by the Creator and is communicated to the Creator through the Platform or other written communication when the Map is published. Any changes to pricing or promotion models apply only to new Maps or to existing Maps where the Creator actively selects or confirms such changes, and do not affect Purchases completed before the change takes effect.

Payouts

You are eligible to receive a payout of your Earnings provided that (a) valid payout information has been supplied, (b) your account is in good standing, and (c) no disputes, chargebacks, or legal issues are pending. A Creator may request a payout by contacting their designated Carta Volta contact.

Payout requests may be submitted no more than once per calendar month and only if the total amount eligible for payout equals or exceeds €10. No interest is payable on balances held prior to payout. Payouts are processed periodically, and while Carta Volta does not guarantee fixed payout schedules, it aims to process approved payout requests within a reasonable timeframe.

Carta Volta may withhold, delay, or reclaim payouts where reasonably necessary, including for pending refunds, chargebacks, reversals, compliance checks, or legal obligations. Reclaimed amounts may be offset against future Earnings, and where this is not possible, may result in a negative balance payable by the Creator upon reasonable notice.

Account Use

A Creator Account allows you to create, edit, publish, or sell Maps, and make changes to your public profile. You are responsible for (a) providing accurate, complete, and up-to-date information, (b) keeping your login credentials secure, and (c) all activity carried out through this account.

You may not misuse the Platform, bypass pricing or technical safeguards, or use Carta Volta for fraudulent, misleading, or unlawful purposes. Carta Volta may temporarily suspend or restrict access to a Creator Account, in whole or in part, to investigate suspected misuse, ensure compliance with these Creator Terms, to protect Users, the Platform, or other Creators, or comply with legal obligations.

Moderation & Removal

Carta Volta is not required to monitor content proactively and may review, limit, suspend, or remove Maps if these Creator Terms are violated, if required by law, or if necessary to protect Users, the Platform, or other Creators. Carta Volta does not guarantee that any Map will be accepted or remain available on the Platform. Where reasonably appropriate, Carta Volta may provide the Creator with a brief explanation of moderation or removal decisions, without being required to do so.

You may request public removal of your Map at any time. Completed purchases remain valid, and Users who previously purchased a Map will retain access to the Map through the Platform for as long as the Map remains technically available, unless removal or restriction is required by law or for legal, regulatory, or safety reasons.

Taxes & Law

You remain solely responsible for determining, declaring, and paying any taxes, social contributions, or other legal obligations arising from the payouts you receive from Carta Volta. Any VAT or similar consumption taxes charged to Users in connection with Purchases are handled by Carta Volta as the merchant of record, in accordance with applicable law.

Disclaimers

The Platform is provided “as is” and “as available,” and Carta Volta makes no guarantees regarding visibility, availability, performance, sales, or income. To the maximum extent permitted by law, Carta Volta is not liable for Creator content, User decisions based on Maps, indirect or consequential damages, or issues caused by third-party services, and Carta Volta’s total liability is limited to the Platform fees paid by you in the three months preceding the event giving rise to the claim, except where liability cannot be excluded under mandatory law.

Indemnification

You agree to indemnify and hold Carta Volta harmless from any claims, damages, losses, or costs arising from (a) your Maps or content, (b) infringement of third-party rights, (c) misleading, unsafe, or unlawful information, (d) breach of these terms, or (e) failure to comply with tax or legal obligations, and this obligation survives termination of your account.

Carta Volta shall (a) promptly notify the Creator of any claim subject to indemnification, provided that failure to give prompt notice does not relieve the Creator of its indemnification obligations except to the extent the Creator is materially prejudiced by such failure and (b) have the right to control the defense and settlement of any such claim, provided that any settlement imposing non-monetary obligations on the Creator requires the Creator’s prior consent, not to be unreasonably withheld.

The indemnification obligations apply only to claims arising from the Creator’s content, actions, or breaches, and do not apply to claims resulting from Carta Volta’s own gross negligence, willful misconduct, or violations of applicable law.

Term Changes

Carta Volta may update these Creator Terms from time to time. After updated terms take effect, continued use of the Platform constitutes acceptance of those changes. Changes to Payment and Platform Fees are always explicitly shared with the Creator before they apply to new Purchases, and these fees do not apply retroactively to earlier completed Purchases.

Termination

Carta Volta may terminate a Creator Account at any time for business, legal, or operational reasons, subject to compliance with applicable law. Where reasonably possible, Carta Volta will provide notice of such termination. A Creator may request termination by sending a written request to creators@cartavolta.com, clearly stating their intention to close their Creator Account.

Termination does not affect outstanding financial or tax obligations, or provisions that by their nature should survive termination. Therefore, Carta Volta may delay or refuse termination of a Creator Account where reasonably necessary to complete pending transactions, resolve disputes, process refunds or chargebacks, or comply with legal or regulatory obligations. Termination takes effect only after confirmation by Carta Volta.

Governing Law

These Creator Terms are governed by Belgian law. Any disputes arising out of or in connection with these Creator Terms are subject to the jurisdiction of the courts at the registered office of Hey You! BV, unless mandatory consumer protection laws provide otherwise.
